Massachusetts Workers’ Compensation Benefits

If you have been injured or have developed a medical condition caused by your employment, you have a potential claim for workers’ compensation benefits. In order to be entitled to a workers’ compensation claim in Massachusetts, you must be able to prove that your injury arose out of and during the course of your employment.

That may be easy to prove if you were injured due to an accident that took place in front of a witness. But in other cases it may be more difficult, such as when an employee is diagnosed with carpal tunnel syndrome caused by repetitive hand motions, or a back injury resulting from heavy lifting, or a reaction to exposure to fumes or chemicals in the work environment.  However straight forward or complicated the injury may be, you can be sure that your employer’s workers’ compensation insurance company will always be trying to get out from its responsibility to pay you the benefits that you deserve.

Types of Workers’ Compensation Benefits

There are many types of benefits under the Massachusetts workers’ compensation statute to which an injured employee may be entitled. Although it varies from case to case depending on the type of injury, limitations (physical and/or emotional) and need for treatment, the basic types of workers’ compensation benefits are:

  • Payment of weekly Disability (Partial or Total) checks;
  • Payment of Medical Expenses;
  • Compensation for any permanent loss of function and/or disfigurement;
  • Compensation for permanent scarring (if on your face or hands);
  • Vocational retraining or education;
  • Mileage reimbursement for your travel to medical appointments.

You Don’t Pay Attorney Fees

Under the workers’ compensation law, if your attorney needs to present a claim on your behalf or to defend against any action brought by the insurance company, the fees that he is due are paid by the insurance company; you will not be billed by your attorney. If you end up receiving a settlement of your case (referred to as a lump sum settlement), then your attorney would be paid a fee of either fifteen or twenty percent of the settlement amount.
