Pursuing a Claim For Social Security Disability Benefits

Life can be difficult and challenging under normal circumstances. For those who are unable to work due to a disability, the difficulties and challenges are often magnified. When you add on to that the fact that a majority of claims for Social Security Disability benefits are initially denied, life can feel overwhelming.

If this is what is happening to you, there are two things that you should do. First, do to not give up, as winning a Social Security Disability claim usually takes time and determination. Second, retain an experienced Social Security Disability attorney who can increase your chance of success by helping guide you through the process and properly presenting your case before the Social Security Administration.

Types of Social Security Benefits

You can be entitled to receive monthly Social Security Disability Insurance (SSDI) benefits if due to a disability you have been unable to work for the past six months with the expectation of being out of work for at least one year due to a physical and/or mental condition.  Through medical evidence, you need to be able to prove that your medical conditions prevent you from engaging in sustained gainful employment.  In other words, you are not able to work day in, day out, week after week.

Those who do not have a sufficient work history under the Social Security Administration regulations will not qualify for Social Security Disability benefits, no matter the extent of their disability.  For those individuals, a claim can be pursued for Supplemental Security Income (SSI) benefits. In order to collect SSI benefits, you still have to prove the presence of a disabling condition as is required for a SSDI claim, but you must also meet certain financial qualifications.

With over thirty years of experience handling disability claims, Attorney Richard C. Hyman has represented hundreds of clients who have impairments that prevent them from working. The Social Security Claims Process

All claims for Socials Security Disability Insurance and Supplemental Security Income benefits begin with the filing of an application, either online or at the local Social Security Administration office. You will then be required to fill out various forms detailing your medical conditions, treatment, work history and description of daily activities. Medical records concerning your medical condition will need to be provided by you or requested by the Social Security Administration.  As stated above, the majority of disability claims are initially denied.  If that happens, the next step is to appeal that Denial (referred to as a Request for Reconsideration). If that too results in a denial of your disability claim, you must again appeal that determination. The next step in the application for disability benefits would be a Hearing before an Administrative Judge who will listen to your testimony (and usually the testimony of a vocational expert), review the medical evidence and thereafter issue a decision either again denying your claim or awarding you disability benefits.
